Jam, LLC, a Nebraska limited liability company, (“Company” or “We”) respects
your privacy and is committed to protecting it through our compliance with this
privacy policy (the “Policy”). This Policy
describes the types of information Company may collect or that you may provide
when you purchase, download, or install, access or use the USA Weather Center application
(the “Application”) and Company practices for collecting, using, maintaining,
protecting, and disclosing that information.
This
Policy applies only to information collected in the Application. This policy
does not apply to information that is collected offline or on any other Company
applications or websites including websites you may access through the
Application or information you provide to or is collected by any third
party.
Please
read this Policy carefully to understand our policies and practices regarding
your information. If you do not agree
with our policies and practices, do not download, register with, or use the
Application. By downloading, registering
with or using the Application, you agree to this Policy. This Policy may change from
time-to-time.
1.
Information
Collection. Company collects information
from and about users of the Application in the following ways:
a.
Directly
from such information that is provided by you;
b.
Automatically
when the Application is used.
2.
Provided
Information. When you download, register
with, or use the Application, you may be asked to provide information by which
you may be personally identified such as name, postal address, email address,
or telephone number (“Personal Information”) or that is about you but
individually does not identify you. This
information includes but is not limited to the following:
a.
Information
that provided by filling in forms in the Application. This includes information provided at the
time of use of the Application. The
Company may also ask you for information when you report a problem with the
Application.
b.
Records
and copies of correspondence (including email addresses and phone numbers) if
you contact the Company.
c.
Details
of transactions carried out through the Application and of the fulfillment of
your orders.
d.
You
may provide information to be published or displayed (“Posted”) on public areas
of accessed through the Application (collectively, “User Contributions”). User Contributions are Posted and transmitted
to others at your own risk. Although you
may set certain privacy settings for such information by logging into your
account profile, please be aware that no security measures are impenetrable. Additionally, Company cannot control the actions
of third parties with whom you may choose to share your User Contributions. Therefore, Company does not guarantee that
your User Contributions will not be viewed by unauthorized persons.

Automatic
Information Collection. When you
download, access, and use the Application, it may use technology to
automatically collect the following:
a.
Usage
Details. When you access and use the
Application, Company may automatically collect certain details of your access
to and use of the Application including traffic data, location of data, logs,
and other communication data and the resources that you access and use on or
through the Application.
b.
Device
Information. Company may collect
information about your mobile device and internet connection, including the
device’s unique device identifier, operating system, browser type, mobile
network information, and the device’s telephone number.
c.
Stored
Information and Files. The Application
may access metadata and other information associated with other files stored on
your device. This may include, for
example, photographs, audio and video clips, personal contacts, and address
book information.
d.
Location
information. The Application does not
collect real time information about the location of your device.
If
you do not want this information to be collected, do not download the
Application or delete it from your device.
Company does not collect Personal Information automatically, but Company
may tie this information to Personal Information about you that we collect from
other sources or from you.

Information
Collection. The technologies Company
uses for automatic information collection may include:
a.
Cookies
(or mobile cookies). A cookie is a small
file placed on your smartphone. It may
be possible to refuse to accept mobile cookies by activating the appropriate
setting on your smartphone. However, if
you select this setting, you may be unable to access certain parts of the
Application.
b.
Web
Beacons. Pages of the Application and
our emails may contain small electronic files known as web beacons (also
referred to as clear gifs, pixel tags and single-pixel gifs) that permit the
Company, for example, to count users who have visited those pages and for other
related Application statistics.
5.
Third-Party
Information Collection. When you use the
Application or its content, certain third parties may use automatic information
collection technologies to collect information about you or your device. These third parties may include:
a.
Advertisers,
ad networks, and ad servers;
b.
Analytics
companies;
c.
Your
mobile device manufacturer;
d.
Your
mobile service provider;
e.
Others.
These third parties may use tracking technologies to collect
information about Application users.
This may include information about users’ use of the Application and
other applications to serve them interested-based advertising. Company does not control these third parties’
tracking technologies or how they may be used.
6.
Use
of Information. Company uses information
collected about you or that you provide to us, including any Personal Information,
to:
a.
Provide
you with the Application and its contents, and any other information products
or services that you request from us;
b.
Fulfill
any other purposes for which you provide it;
c.
Give
you notices and your account/subscription including expiration and renewal notices;
d.
Carry
out Company obligations and enforce Company rights arising from any contracts;
e.
Notify
you when Application updates are available, and of changes to any products or
services Company offers or provides through it.
The usage information collected helps Company to improve the
Application and to deliver a better and more personalized experience by
enabling us to:
a.
Estimate
audience size and usage patterns;
b.
Store
information about your preferences, allowing customization of the Application
according to your individual interests;
c.
Speed
up your searches;
d.
Recognize
you when you use the Application.
7.
Disclosure
of Information. Company may disclose
aggregated information about our users and information that does not identify
any individual or device without restriction.
In addition, Company may disclose Personal Information that is collected
or that you provide to the following:

Company’ subsidiaries and affiliates;

To
contractors, service providers and other third parties Company uses to support
the Application;

To
a buyer or other successor in the event of a merger, divestiture, restricting,
reorganization, dissolution or other sale or transfer of some or all of the
Company’s assets, whether as a going concern or as part of bankruptcy, liquidation,
or similar proceeding, in which personal information held by the Company about
our Application users is among the assets transferred;

third parties to market their products or services to you if you have consented
to these disclosures;

To
fulfil the purposes for which you provide it;
f.
For
any other purpose disclosed by Company when you provide the information;

With
your consent;
h.
To
comply with any court order, law, or legal process, including to respond to any
government or regulatory request;

enforce Company rights arising from any contracts entered into between the
Company and you, including the End User License Agreement;
j.
If
we believe disclosure is necessary or appropriate to protect the rights,
property, safety of the Company or others.
8.
Data
Security. The Company has implemented
measures designed to secure your personal information from accidental loss and
from unauthorized access, use, alteration, and disclosure. All information you provide to us is stored
on our secure servers behind firewalls.
The
safety and security of your information also depends on you. Where the Company has given you or where you
have chosen a password for access to certain parts of the Application, you are
responsible for keeping this password confidential.
The
transmission of information via the internet and mobile platforms is not
completely secure. The Company does not
guarantee the security of your personal information transmitted through our Application. Any
transmission of personal information is at your own risk. The Company is not responsible for
circumvention of any privacy settings or security measures we provide.
9.
Changes
to Privacy Policy. The Company may
update the privacy policy from time-to-time.
If Company makes material changes to how Personal Information is
treated, the new policy will be posted.
The date the privacy policy was last revised is identified at the top of
the page.
